A. TRADEMARKS, PATENTS AND UTILITY MODELS.

With the aim of establishing new regulations, set forth new rules and guarantee national rights in the same way that in the majority of the nations foreign intellectual property rights are protected, the Republic of Panama has introduced provisions to its legislation, in order to adapt it to new international regulations (Law N° 35 of 1996) and has signed and ratified the Paris Convention for the Protection Industrial Property, of general acceptance and application in the international community.

The introduced legislation has offered a solution to the legal obscurity that previous legislation left in matters of Industrial Property (IP), bringing more certainty, security and better conditions for national and foreign investments, by establishing new regulations concerning Commercial Names, Trademarks, Patents and Utility Models.

Trademark Registration in the Republic of Panama.

The registry of a trademark assures its owner exclusive usage rights of said trademark, the right to oppose the registry request of a trademark by other person, be it identical or similar to the registered trademark that protects products under the same class, and the right to claim against the unlawful use of registered trademarks.

Any person or corporation, national or foreign, has the right to register a trademark in Panama, without consideration of its domicile.

Registration of Inventions Patents and Utility Models.

The registry of patents and utility models is possible, whether they are national or foreign, always providing that they are not patents or models of public domain.
